The common claim vs. the evidence

What’s commonly claimed, and what the evidence supports

Kirkland Signature Vita Rain (a Vitaminwater-style enhanced water) is widely assumed to be a generic Costco product with no known maker. The strongest documented lead points to Niagara Bottling: in the 2012-2013 federal class action Maple v. Costco (E.D. Wash., 12-cv-05166), Niagara Bottling LLC was named alongside Costco as the manufacturer of Kirkland VitaRain. Because that record is more than a decade old, was dismissed on standing (so the court made no factual finding), and predates today's reformulated 'Vita Rain Zero' line, the attribution is graded probable rather than confirmed, and it lines up with the separate, independently-sourced indication pointing to Niagara for Kirkland purified water.

Evidence & sources

Each source is graded on the six-tier evidence rubric, where tier 1 is strongest. Sources are archived, so a citation still works if the original page moves or goes behind a paywall.

Tier 4 TruthInAdvertising.org (TINA.org) VitaRain Water Published · accessed July 6, 2026

Advertising-law watchdog page reproducing the federal court caption "Costco Wholesale Corporation, Niagara Bottling LLC, and Does 1-100," Case No. 12-cv-05166 (E.D. Wash.), and reporting: "A federal judge dismissed a class-action lawsuit against Costco Wholesale Corp. and Niagara Bottling, LLC." Niagara Bottling LLC was named as the manufacturer/bottler co-defendant for Costco's Kirkland VitaRain enhanced water. Court-record class: a defendant's presence in a complaint is an on-the-record naming (tier 4), not an adjudicated finding: the suit was dismissed in November 2013 on standing grounds (plaintiff Maple had not read the label), so nothing was decided about the label's truth, only who the parties were. CourtListener docket #4408847 independently lists 'Niagara Bottling LLC' among the parties (that page is Cloudflare-walled and could not be archived).

Frequently asked

Who makes Kirkland Signature Vita Rain enhanced water?

Evidence points to Niagara Bottling, the large California-based private-label bottler. In the 2012-2013 federal class action Maple v. Costco (E.D. Wash., 12-cv-05166), Niagara Bottling LLC was named alongside Costco as the manufacturer of Kirkland VitaRain. That court record is over a decade old and was dismissed on standing without any ruling on the merits, and the current product is a reformulated 'Zero' line, so we grade this probable rather than confirmed. Costco does not otherwise disclose the bottler.

Is Kirkland Vita Rain the same as Vitaminwater?

It is a close comparison (an enhanced water positioned against Glaceau Vitaminwater Zero, which is why the two are often compared), but they are different products. The 2012-2013 lawsuit actually turned on whether Kirkland VitaRain's label ('natural caffeine,' 'natural tonic') was misleading; it was dismissed on a technicality, not decided on the merits.

Does the same company make Kirkland water and Kirkland Vita Rain?

The evidence points to the same bottler for both: Niagara Bottling is the company indicated for Kirkland purified water, and Niagara Bottling LLC was the manufacturer co-defendant named for Kirkland VitaRain in the 2012-2013 Maple v. Costco case. Neither attribution is confirmed (both are graded probable), and the bottler line and plant code printed on a current pack identify who actually filled it.
